TERMS & CONDITIONS

Customer T&C’s

 

1. DEFINITIONS

"Build your party" means build your party of Lodge Park, Lodge Lane, Langham, Colchester, Essex, CO4 5NE

"Build your party website" means the website currently owned and operated by Build your party at the following web address :-

www.buildyourparty.co.uk

"Buyer" means the individual or organisation who buys or agrees to buy the goods and/or services from  Build Your Party

“Service” means a business or organisation listed on the build your party website, which can be booked or reserved.

 

2. CONDITIONS

2.1 These Terms and Conditions shall apply to all contracts for the sale of goods and/or services via Build your party to the Buyer and shall prevail over any other documentation or communication from the Buyer.

2.2 No variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be applicable unless agreed in writing by Build your party.

2.3 Any complaints should be addressed to Build your party address stated in Section 1.

 

3. RESERVATIONS / ORDERS

3.1 All orders for goods and/or services via the Build your party shall be deemed to be an offer by the Buyer to purchase pursuant to these Terms and Conditions and are subject to acceptance by Build your party.

3.2 When making a purchase through the Build your party, the sequence to be followed is as listed below;

The Buyer will;

- Take reasonable care to ensure that the products and services to be purchased are suitable for the purpose intended. The Build your party website will contain a guideline only of the prices and brief information of the products and services offered as received by the service provider. These prices are subject to verification from the service provider.

- Understand the price and deposits, which will be received in an invoice,  are your responsibility to be paid, once requested and no booking is confirmed until the agreed deposit has been paid.

- Be responsible for reading the Customer T&C’s as published on the Build your party website and Read the terms and conditions supplied via build your party through post or email for each of the services purchased.

- From the Cart screen, complete the reservation form and submit together with checkout form to Build your party. All displayed and entered information will be in the English language and only required information to be passed on to the service booked.

After the order has been accepted by Build your party and reservation information has been received and cleared, Build your party will either forward by regular post, or via Email to the Buyer :-

- Either an invoice containing a total price and deposit price needed. With clear deadlines on the time scales the buyer has to complete.  

- A Receipt for payment (if applicable) having received this via telecommunication or internet payment.

 Once payments are made, buyer will receive from build your party;

- Booking confirmation, which confirms the service have accepted the buyers purchase. The booking confirmation will list the services purchased, their terms and conditions and agreed dates/ times. 

  

4. BOOKING CANCELATIONS

4.1 Should the Contract need to be cancelled by the Client, the following conditions apply;

- Written notification must be received and acknowledged by Build your party at least 28 days prior to the scheduled date.

- If there was no notification received and acknowledged at least 14 days prior to the performance then Build your party will not be eligible to refund the client’s deposit. If no notification is received by the day of the booking then the client will be responsible to pay the full-agreed price to Build your party.

4.2 The Client shall not be required to pay Build your party for any engagement where we are unable to perform by reason of any cause beyond the Client's control such as National Mourning, snow, War, Fire, Acts of Terrorism, Strikes or Lock-Outs directly affecting the venue, or the by Order of the Licensing or any Public Authority having jurisdiction.

 

 5 Build your party RIGHTS

5.1 Build your party reserves the right to periodically update prices on the Build your party Website, which cannot be guaranteed for any period of time.

5.2 Build your party reserves the right to withdraw or discontinue to offer any Goods and/or Services from the Build your party Website at any time and shall not be liable to anyone as a consequence.

 

6. LIMITATION OF LIABILITY

6.1 In the event of any breach of these Terms and Conditions by Build your party the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and/or Services and Build your party shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

6.2 Nothing in these Terms and Conditions shall exclude or limit the liability of Build your party for death or personal injury resulting from the negligence of Build your party or its employees.

6.3 Build your party works as an intermediary between the buyer and the service provider. If there is any issue or problems the buyer has with any service booked through build your party then the buyer must deal with this service provider directly. Build your party will pass on the buyer’s complaint unless the complaint is directly to do with Build your party.

 

7. WAIVER 

No waiver by Build your party (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

 

8. FORCE MAJEURE

Build your party shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and Build your party shall be entitled to a reasonable extension of its obligations.

 

9. SEVERANCE

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

 

10. CHANGES TO TERMS AND CONDITIONS

Build your party shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

 

11. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

 

Service T&C’s

“Service” means a business or organisation listed on the build your party website, which can be booked or reserved.

2.1 These Terms and Conditions shall apply to all contracts to any service booked via Build your party and shall prevail over any other documentation or communication from the service.

2.2 No variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be applicable unless agreed in writing by Build your party.

2.3 Any complaints should be addressed to the Build your party address stated in Section 1.

 

3. CONTRACTS

3.1 All bookings via the Build your party website shall be deemed to be an offer by the Buyer to purchase pursuant to these Terms and Conditions and are subject to acceptance by the service.

3.2 When accepting a booking from Build your party, the sequence to be followed is as listed below :-

The service will agree to :-

- Once booking is accepted, take reasonable care to ensure that the products and services booked are suitable for the purpose intended. The Build your party website will contain a guideline only of the prices and brief information of the products and services offered and as the service provider you are required to make sure this is up to date and relative.  

- Understand the  final payments will be received after the scheduled date directly from build your party once they have received payment from the buyer. Unless an alternative payment method has been agreed in writing.  

- Service providers are responsible for reading, understanding and adhering to the Customers T&C’s and the Service’s T&C’s as published on the Build your party website.

- Build your party will need an up to date copy of your Terms and conditions to be passed on to the buyer. It will be your responsibility to update build your party if there are any changes to your terms and conditions.

After a deposit has been paid to Build your party, Build your party will either forward by regular post, or via Email to the service :-

 - A Booking Proposal. The booking proposal will list the services purchased, our terms and conditions and agreed dates/times.

-Then Pay a Deposit to the service provider.

-It is now the service sole responsibility to complete the agreed reservation and notify Build your party if they need to cancel a contract as per terms listed in section 5.

  

4. CONTRACT CANCELATION

4.1 Should the Contract need to be cancelled by the service, the following conditions apply;

- Written notification must be received and acknowledged by Build your party at least 28 days prior to the scheduled date.

-The service will be eligible to refund the deposit paid by build your party.

- If no notification is received by the day of the booking then the service will be responsible to pay any difference from the original prices booked to ensure an alternative service was provided to the buyer.

4.2 The service shall not be required to pay Build your party for any engagement where they are unable to offer a service by reason of any cause beyond the service’s control such as National Mourning, snow, War, Fire, Acts of Terrorism, Strikes or Lock-Outs directly affecting the venue, or the by Order of the Licensing or any Public Authority having jurisdiction.
